Overview
The Plenary of the National Council of Justice (CNJ) unanimously approved a resolution during the 17th Ordinary Session of 2023, with the aim of combating discrimination against sexual orientation and gender identity in the Judiciary. The resolution also regulates the adoption, custody and guardianship of children and adolescents by couples or single-parent, same-sex or transgender families. The guidelines, established in Normative Act 0007383-53.2023.2.00.0000, instruct courts and magistrates to promote equal rights, prohibiting discriminatory attitudes towards these types of families in licensing processes and adoption cases. The resolution originated in a letter presented by senator Fabiano Contarato to the Council in June. The senator highlighted the importance of the resolution as the materialization of a constitutional commandment, citing article 3, item 4, of the Federal Constitution, which advocates the promotion of the well-being of all and the abolition of any and all forms of discrimination. The approval of the resolution was highlighted as an important step towards eliminating discrimination in judicial activities and guaranteeing fundamental rights to family formation. The analysis and debate process involved the National Forum for Children and Youth, which organized a committee to prepare the proposal, with the contribution of entities, adoption support groups and gay and trans families.
